Attached is the judgement. It considers individual derogation granted by the Commission to EU persons (Clearstream in the case) to comply with secondary US sanctions falling within the scope of the EU Blocking Statute.
The judgement is authority (among others) that:
•the procedure provides no right for an interested person to be heard when making a decision (Para 38);
•no decision need to be communicate to a person (Ibid); and
•authorizations may be granted with retroactive effect (Paras. 92 – 96).
•In essence, it is very unlikely that any challenge of such an authorization will succeed.
