General Court judgement in Case T-541/24 – Dmitry Pumpyanskiy vs. Council

Attached is the text of the judgement. The judgement is a repeat annulment of blocking sanctions against the applicant within JR process. It is an important example of a situation when repeated annulments of listing (and re-listing) of blocked persons by the General Court do not result in a positive action of the Council to remove such persons from the blockings lists. The judgement is further authority as to (among other matters): (i) the lawfulness of the Council amending listing criteria and re-listing a person under such a new criteria; (ii) the unlawfulness of listing a person on the basis of evidence which was not available to the Council at the time when the relevant initial listing decisions (or a decision to continue listing) were made; and (iii) that prior positions of a listed person (which such person resigned from at the time of renewing restrictive measures) are not a good justification to continue to list such a person. The judgement also sets out the rigour of evidence review and the application of leading businessmen / businessmen criterion in listing individuals to blocking sanctions.
